On 15 September 2026, the European Parliament, at its plenary session, considered and voted on its position on the legislative proposal to extend the scope of the Carbon Border Adjustment Mechanism (CBAM) to downstream products and to introduce additional anti-circumvention measures.

Among the adopted amendments are provisions relevant to Ukraine as a candidate country for EU accession. In particular, they provide for taking into account exceptional circumstances caused by a prolonged military conflict and its impact on economic and industrial infrastructure, as well as the possibility of introducing temporary measures under CBAM in such cases.

The Ministry of Economy and Environment of Ukraine draws attention to the fact that this is a first reading under the EU ordinary legislative procedure, and not the final adoption of amendments to the CBAM Regulation. Members of the European Parliament voted on a number of amendments to the text and then supported the European Commission’s proposal as a whole, taking into account the adopted amendments. At the proposal of the European Parliament’s rapporteur on CBAM, Mohammed Chahim, Parliament also decided to refer the matter back to the responsible Committee on the Environment, Public Health and Food Safety (ENVI) for the opening of interinstitutional negotiations.

This means that the text agreed today constitutes the European Parliament’s position for further negotiations, and not the final wording of the Regulation. The final version of the CBAM amendments will be determined only following the trilogue between the European Parliament, the Council of the EU and the European Commission, and this text may differ from the position approved on 15 September. The timeline for concluding the negotiations has not yet been set.

The Ministry of Economy is closely monitoring the progress of the EU legislative process on CBAM, in particular with regard to the extension of the mechanism to downstream products and anti-circumvention measures, as these changes may be of significance for Ukrainian exporters. The content of the finally agreed text and its possible implications for Ukrainian businesses will be communicated separately, after the conclusion of interinstitutional negotiations and the publication of official documents.
