Waste management regulations simplified and administrative burden on businesses reduced

Businesses operating in the waste management sector will be subject to updated, clearer and more flexible rules. This step is expected to help maintain a balance between environmental requirements and the actual operating conditions of industry during martial law. The decision was adopted by the Government on 30 October.

In particular, the changes provide for:

  • Developing a landfill control and monitoring programme for a five-year period instead of updating it annually;
  • Simplifying the classification of production residues as by-products;
  • Facilitating the process of obtaining a conclusion for the transboundary shipment of certain types of waste;
  • Aligning environmental measures with the new waste management legislation. This will eliminate legal uncertainty when financing such measures from the State Fund for Environmental Protection;
  • Introducing transitional provisions for business entities participating in the experimental project on the simplified procedure for obtaining permits to carry out waste treatment operations. These provisions will allow businesses to bring their waste treatment activities into compliance with the requirements of the Law of Ukraine “On Waste Management” and the Procedure for Issuing, Refusing to Issue and Terminating Permits for Waste Treatment Operations, approved by Resolution No. 1328 of the Cabinet of Ministers of Ukraine dated 19 December 2023.

The proposed changes will support the competitiveness of Ukrainian producers in the European market and contribute to environmental protection and public health.
