Doing business
On June 18, the Verkhovna Rada adopted Draft Law No. 11469 in its entirety, introducing the institution of multiple citizenship in Ukraine. The decision was supported by 243 members of parliament.
“Today is a historic day for Ukraine. This decision is a significant step toward preserving and restoring connections with millions of Ukrainians around the world,” emphasized Oleksii Chernyshov.
The Deputy Prime Minister underlined that the adoption of the law on multiple citizenship addresses the challenges of a globalized world:
“This is our step toward the European Union and 130 democratic countries where this practice has long been the norm. I thank the members of parliament for their support, and all those who made this possible!” stated Chernyshov.
The new law allows Ukrainian citizens to officially hold passports of other countries without losing their Ukrainian citizenship. However, this applies only to states included on a special list to be approved by the Cabinet of Ministers. The law does not specify how frequently this list must be updated.
Dual citizenship with the aggressor state is strictly prohibited. Holding a Russian passport will automatically result in the loss of Ukrainian citizenship, except in cases of forced or automatic acquisition.
Recognized Cases of Dual Citizenship:
The law introduces a new Article 5-1, which regulates cases in which Ukrainian citizens may hold a second citizenship. These include:
New Provisions for Foreign Nationals:
Individuals of Ukrainian origin will benefit from a simplified naturalization process. A separate procedure is introduced for those without Ukrainian heritage. Foreign nationals may acquire Ukrainian citizenship without renouncing their existing citizenship (except citizens of aggressor states). Simplified rules will apply to members of the Armed Forces of Ukraine and individuals facing political persecution in their home countries.
Restrictions and Requirements:
On the territory of Ukraine, persons with dual citizenship will be recognized solely as Ukrainian citizens. To obtain citizenship, individuals must pass exams on the Constitution, Ukrainian history, and language. Multiple citizenship is prohibited for civil servants and judges.
Background:
President Volodymyr Zelenskyy submitted the draft law to the parliament on August 7, 2024. The purpose of the law is to modernize the legal framework for citizenship in light of national security needs, to maintain unity within the Ukrainian community, and to address the demographic crisis caused by Russian aggression. The relevant parliamentary committee reviewed the bill twice— in May and June— following additional proposals from the Servant of the People party and the Ministry of National Unity.
